Official Terms of Service Charter
People's Democratic Republic of Algeria • Law 18-05 & 09-03 Compliant
Effective: October 2026
Article 1: Scope of Agreement & Legal Capacity
This document constitutes a legally binding agreement between you and the Taqym Algeria platform. By accessing the site, browsing business listings, creating an account, or registering a commercial entity, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service, our Privacy Policy, and Reviewer Guidelines.
You represent and warrant that you are at least 18 years of age (the age of civil majority in Algeria) or possess legal parental authorization. If entering this agreement on behalf of a commercial business, company, or auto-entrepreneur entity, you warrant that you hold full legal authority to bind that entity to these conditions.
Article 2: Platform Status, Independence & Neutral Intermediary
Taqym operates strictly as an independent third-party technological intermediary (Hosting Provider / Platform) designed to foster public transparency by enabling consumers to document and share genuine purchasing experiences regarding commercial pages and stores across Algeria's 69 wilayas.
Guarantees of Independence & Neutrality:
• Taqym is neither a retailer, nor a payment processor, nor an owner of any listed commercial brands.
• Taqym does not intervene in financial transactions, order fulfillment, warranty execution, or parcel delivery between merchant and customer.
• Taqym maintains absolute algorithmic and editorial neutrality. Under no circumstances can any commercial business, regardless of subscription tier or verified standing, purchase the suppression of critical reviews, alter its organic Taqym Score, or manipulate directory rankings.
Article 3: Account Registration, Integrity & Security
To access specific features (such as authoring reviews, claiming store listings, or publishing official merchant responses), users must register an individual or business account.
User Obligations:
• Provide truthful, accurate, and up-to-date identification data, including valid email credentials and geographic location (Wilaya).
• Maintain the confidentiality of your login credentials and immediately notify Taqym support of any suspected unauthorized access.
• Impersonating any individual or business, generating burner/sock-puppet profiles, or maintaining duplicate accounts to manipulate rating scores is strictly prohibited and grounds for immediate termination.
Article 4: Review Integrity Code & Reviewer Conduct
Review authenticity is the core principle of Taqym. Every author submitting feedback covenants to adhere to the following standards:
1. Genuine Personal Interaction: The review must originate from a bona fide commercial transaction, order placement, or direct customer service engagement taking place within the preceding 12 months.
2. Prohibition of Defamation & Hate Speech: Reviews must not contain abusive, defamatory, threatening, obscene, or hateful language directed at businesses or their employees, pursuant to Algerian Penal Code provisions safeguarding personal dignity.
3. Fact-Based Objectivity: Reviews must depict concrete factual facets of the transaction (product conformity, pricing, parcel condition, communication) rather than unfactual criminal accusations ('scammers', 'thieves') absent formal judicial rulings.
4. Anti-Extortion Prohibition: Reviewers may never utilize reviews or threat of negative feedback as coercive leverage to extort refunds, unauthorized discounts, or free merchandise from sellers.
5. No Incentivized or Purchased Feedback: Reviewers are strictly forbidden from accepting monetary kickbacks, complimentary goods, or discounts in exchange for disingenuous 5-star ratings.
Article 5: Merchant Responsibilities & Anti-Manipulation Mandate
Merchants, corporate enterprises, and social selling pages listed on Taqym are bound by strict conduct rules under Algerian Electronic Commerce Law 18-05:
1. Credential Truthfulness: Submitting legitimate Commercial Register (RC) records, valid national Auto-entrepreneur cards, and authentic corporate contact information when requesting verified business status.
2. Strict Ban on Astroturfing: Store owners, managers, staff, relatives, and affiliated marketing contractors are unequivocally prohibited from authoring reviews for their own business or submitting destructive negative reviews against commercial competitors.
3. Zero Retaliation or Reviewer Intimidation: Merchants may not threaten, harass, withhold statutory warranties from, or initiate frivolous legal action against consumers who publish honest, evidence-based critical reviews. Documented merchant intimidation triggers a public 'Consumer Alert' banner on the business profile.
4. Professionalism in Replies: Official replies must remain courteous, professional, and resolution-oriented. Publishing the consumer's private home address, private phone number, or payment details in a public reply is strictly illegal.
Article 6: Intellectual Property & Content Licensing
• User Content Ownership: Review authors retain copyright in their original review texts and photographs. By submitting content on Taqym, the user grants Taqym a perpetual, irrevocable, non-exclusive, royalty-free, worldwide license to display, publish, translate, and index the content in connection with operating the service.
• Platform Proprietary Assets: All visual identities, brand marks, software architectures, algorithms (including Taqym Score computations), and compilation databases are the exclusive intellectual property of Taqym, protected under Algerian intellectual property codes and international treaties. Automated extraction, unauthorized scraping, or systematic reproduction is strictly prohibited.
Article 7: Verification and the Taqym Score
• Verified Business Badge: Conferred exclusively to commercial entities that have successfully cleared compliance validation of their Algerian Commercial Register (RC), official Auto-entrepreneur credential, and representative identity verification.
• Verified Purchase Badge: Bestowed upon reviews audited by our compliance team against valid proof of purchase (order confirmation, courier delivery slip, or tax invoice).
• Taqym Score: the plain average of a store's published reviews, from 1 to 5. No store can pay to change it.
Article 8: Content Flagging, Dispute Resolution & Moderation
Taqym provides a structured, impartial dispute resolution framework for contested reviews:
1. Flagging Procedure: Any registered consumer or merchant representative may flag a review citing specific breaches of these Terms accompanied by relevant evidence.
2. Burden of Proof: If a merchant challenges a review claiming the reviewer was never a bona fide customer, our compliance desk requests proof-of-purchase from the reviewer, providing a 5-day response window.
3. Resolution Outcomes: If the reviewer produces valid transaction proof, the review remains active and receives a 'Verified Purchase' trust badge. If the submission is proven fabricated, malicious, or defamatory, it is permanently removed.
4. Evidentiary Confidentiality: Proof documents provided during disputes are audited in our secure vault and never transferred to the opposing party.
Article 9: Disclaimer of Warranties & Limitation of Liability
• Published reviews represent the subjective opinion and direct factual statements of their respective authors and do not reflect the institutional opinion, endorsement, or liability of Taqym.
• Taqym disclaims all liability for product defects, commercial defaults, delivery delays, transit loss, or damages attributable to independent courier providers (such as Yalidine, ZR Express, or postal carriers).
• Taqym services are provided on an 'as-is' and 'as-available' basis without warranties of uninterrupted uptime or error-free accessibility.
• To the maximum extent permitted under Algerian law, Taqym shall not be liable for indirect, incidental, or consequential damages, including loss of business profit resulting from legitimate, authentic public feedback.
Article 10: Sanctions, Account Suspension & Consumer Warnings
In the event of material violations of these Terms, Taqym reserves the right to impose disciplinary sanctions without liability:
1. Issuing formal regulatory warnings to the violating account.
2. Immediate deletion of tainted, manipulated, or fraudulent reviews with algorithmic score recalculation.
3. Affixing a public 'Consumer Alert' banner to the profile of any merchant caught fabricating reviews, purchasing endorsements, or intimidating shoppers.
4. Suspending, terminating, or permanently blacklisting user or business accounts and associated IP ranges.
5. Reporting severe criminal extortion, commercial forgery, or cyber-harassment to competent Algerian law enforcement agencies.
Article 11: Governing Law & Algerian Judicial Jurisdiction
These Terms and any non-contractual obligations or claims arising out of them are governed by and construed in accordance with the substantive laws of the People's Democratic Republic of Algeria, specifically including:
• Law No. 18-05 on Electronic Commerce.
• Law No. 09-03 on Consumer Protection and Fraud Repression.
• Law No. 18-07 on Personal Data Protection.
• Relevant Algerian Penal Code provisions concerning digital defamation and cybercrime.
In the event of any controversy, the parties agree to seek amicable resolution through Taqym's internal mediation desk for a period of 30 days. Should informal resolution fail, exclusive jurisdiction is submitted to the competent territorial courts of the People's Democratic Republic of Algeria.
Article 12: Amendments, Statutory Notices & Legal Inquiries
Taqym reserves the right to amend these Terms of Service periodically to address statutory updates in Algeria or platform feature evolutions. Amendments take immediate effect upon publication at this URL. Continued engagement with Taqym following revisions constitutes explicit assent.
